Natura juridică a abuzului de drept

Abstract

The purpose of the article is to provide an analysis of the legal nature of the abuse of right. The analysis of this principle of law is undertaken with a view of its two essential elements: the subjective one and the objective one. In the mean time we will try to highlight the common features and the differences from other legal notions such as illegal action, the cause of the legal act and the interest.

În articol este abordată problematica naturii juridice a abuzului de drept. Acest principiu de drept este analizat prin prisma celor două elemente care îl caracterizează: elementul subiectiv şi cel obiectiv. La fel, sînt punctate asemănările şi deosebirile faţă de alte instituţii juridice precum: fapta ilicită, cauza actului juridic şi interesul.
