În prezentul demers se examinează reglementarea procedurii de prezentare pentru recunoaștere a animalelor în conformitate cu legislația Republicii Moldova, evidențiind particularitățile teoretice și practice ale acesteia în contextul actualei jurisprudențe. Sunt analizate aspectele tactico-criminalistice ale activității de identificare a animalelor ca mijloc probator, cu accent pe dificultățile întâmpinate în aplicarea normelor procesual-penale existente. Pe baza evaluării practicii judiciare și a lacunelor normative constatate, se argumentează necesitatea modificării cadrului legal în vederea asigurării eficienței și legalității acestei activități procesuale.
The present study examines the legal regulation governing the procedure of presenting animals for identification under the legislation of the Republic of Moldova, highlighting its theoretical and practical particularities within the framework of contemporary judicial practice. The paper analyzes the tactical and forensic aspects of the identification of animals as a means of evidence, with particular emphasis on the difficulties encountered in the application of the existing criminal procedural norms. Based on an assessment of judicial practice and the identified normative gaps, the necessity of amending the legal framework is substantiated in order to ensure the efficiency and lawfulness of this procedural activity.
