Studiulul comparativ privind înregistrarea bunurilor imobile în Republica Moldova și România

Abstract

Realizarea unei analize comparative a procedurilor de primă înregistrare a apartamentelor în sistemele cadastrale din România și Republica Moldova. Lucrarea urmărește identificarea diferențelor legislative și tehnice, evaluarea eficienței fluxurilor de lucru digitalizate și evidențierea rolului instituțiilor responsabile în garantarea dreptului de proprietate. Lucrarea cuprinde trei capitole ce detaliază pașii necesari pentru prima înregistrare a unui apartament, concluziile finale validând corectitudinea întocmirii documentației cadastrale și prezentând o analiză comparativă a soluțiilor digitale utilizate în România și Republica Moldova. Capitolul 1. Cuprinde analiza normelor juridice fundamentale, precum Legea nr. 7/1996 (România) și Legea nr. 1543/1998 (Republica Moldova). Sunt detaliate conceptele de publicitate imobiliară, dreptul de proprietate și modul de organizare a instituțiilor de profil (ANCPI și AGCC). Capitolul 2. Se concentrează pe tehnologiile moderne utilizate în activitatea inginerului cadastral. Sunt descrise metodele de măsurare pe teren cu ajutorul telemetrelor laser, stațiilor totale și sistemelor GNSS (ROMPOS/MOLDPOS), precum și soluțiile software pentru procesarea datelor și generarea documentației tehnice. Capitolul 3 Este dedicat studiului de caz, prezentând etapele concrete ale întocmirii documentației pentru un imobil. Include analiza comparativă a rezultatelor, evidențiind avantajele digitalizării (sistemul eTerra) și propuneri pentru optimizarea proceselor de înregistrare în ambele state. La finalul lucrăii sunt incluse concluzii și cîteva recomandări, bibliogarfie și anexe.

This bachelor’s thesis performs a comparative analysis of the procedures for the first registration of apartments within the cadastral systems of Romania and the Republic of Moldova. The study aims to identify legislative and technical differences, evaluate the efficiency of digitalized workflows, and highlight the role of the responsible institutions in guaranteeing property rights. The structure of the thesis includes: The work is divided into three chapters that detail the necessary steps for the first registration of an apartment. The final conclusions validate the accuracy of the cadastral documentation and present a comparative analysis of the digital solutions used in Romania and the Republic of Moldova. Chapter 1 comprises the analysis of fundamental legal norms, such as Law no. 7/1996 (Romania) and Law no. 1543/1998 (Republic of Moldova). Concepts of real estate publicity, property rights, and the organizational structure of specialized institutions (ANCPI and ASP) are detailed. Chapter 2 focuses on modern technologies used in the cadastral engineer's activity. It describes field measurement methods using laser rangefinders, total stations, and GNSS systems (ROMPOS/MOLDPOS), as well as software solutions for data processing and the generation of technical documentation. Chapter 3 is dedicated case study, presenting the concrete stages of preparing the documentation for a property. It includes a comparative analysis of the results, highlighting the advantages of digitalization (the eTerra system) and providing proposals for optimizing registration processes in both states. At the end of bachelor’s thesis, conclusions and some recommendations, bibliograthy and annexis are included.
