Lucrări cadastrale prin combinare la nivel de teren cu sau fără construcții în localitatea Voinescu din raionul Hîncești

Abstract

Lucrarea de licență are drept scop analiza aspectelor juridice, tehnice și metodologice privind formarea bunurilor imobile prin metoda combinării. Scopul lucrării constă în studierea cadrului normativ aplicabil și în prezentarea modului de executare a lucrărilor cadastrale necesare pentru unirea a două sau mai multe bunuri imobile într-un singur bun nou-format. În partea teoretică sunt analizate noțiunile generale privind cadastrul bunurilor imobile, metodele de formare a bunurilor imobile cum ar fi: separare, divizare, comasare, combinare și separare, precum și rolul inventarierii bunurilor imobile în procesul de actualizare a evidenței cadastrale. De asemenea, sunt prezentate documentația cadastrală necesară, etapele executării lucrărilor cadastrale și importanța măsurătorilor geodezice în asigurarea exactității datelor. Prezenta lucrare este structurată în: introducere, 3 capitole, concluzii generale, și bibliografie. Capitolul 1 se intitulează ”METODETELE DE FORMARE A BUNURILOR IMOBILE“ , acesta descrie partea teoretică a tezei de licență, și anume în acest capitol sunt descrise cele 4 metode de formare a bunurilor imobi și procedura de executare a acestora, precum și conținutul și documentația cadastrală efectuată la lucrările de formare. În capitolul 2 intitulat „DOCUMENTAȚIA CADASTRALĂ NECESARĂ PENTRU INVENTARIERE“ sunt reprezentate etapele efectuării unei lucrări de inventariere precum și structura acesteia. Procedura de lucru pentru inventarierea bunului imobil este compusa din mai multe etape, și anume: lucrări pregătitoare, identificarea bunului imobil, măsurători cadastrale și descrierea elementelor constructive și culegerea datelor privind dotarea cu rețele a bunului imobil, actualizarea planului cadastral, întocmirea sau modificarea planului geometric, calcularea parametrilor tehnici, întocmirea raportului lucrării, recepția lucrărilor cadastrale, eliberarea documentației cadastrale. În capitolul 3, studiu de caz care este intitulat „LUCRĂRI CADADASTRALE PRIN COMBINARE LA NIVEL DE TEREN CU SAU FĂRĂ CONSTRUCȚII ÎN LOCALITATEA VOINESCU DIN RAIONUL HÎNCEȘTI” este analizată meroda de formare a bunurilor imobile prin combinare în baza contractului de vânzare-cumpârare. De asemenea este descrisă detaliat întreaga procedura cu toți pașii pentru a obține un raport bine structurat conform instrucțiunii în vigoare.

The thesis aims to analyze the legal, technical, and methodological aspects related to the formation of real estate properties through the method of combination. The purpose of the thesis is to study the applicable regulatory framework and to merge two or more real estate properties into a single newly formed property. The theoretical part analyzes the general concepts regarding the cadastre of real estate properties, as well as the methods of forming real estate units, such as subdivision, division, amalgamation, combination, and updating cadastral records. In addition, the thesis presents the necessary cadastral documentation, the stages of cadastral works, and the importance of geodetic measurements is ensuiring the accuracy of the data. The thesis is structured as follows: introduction, three chapters, general conclusion, and bibliography. Chapter 1, entitled “METHODS OF FORMING REAL ESTATE PROPERTIES”, presents the theoretical foundation of the thesis. This chapter describes the four methods of forming real estate properties and the procedures for carryng them out, as well as the content and cadastral documentation prepared during such works. Chapter entitled “CADASTRAL DOCUMENTATIN REQUIRED FOR INVENTORY”, presents the stages involved in performing an inventory work and its structure. The procedure for inventorying a real estate property consists of several stages, namely: preparatory works, identification of the property, cadastral measurements and descrfiption of structural elements, collection of data regarding the utility networks serving the property, updating the cadastral plan, preparation or amendment of the geometric plan, calculation of thecnical parameters, preparation of the work report, acceptance of cadastral works, and issuance of cadastral documentation. Chapter 3, the case study entitled “CADASTRAL COMBINATION WORKS AT LAND LEVEL, WITH OR WITHOUT BUILDINGS, IN THE LOCALITY OF VOINESCU, HÎNCEȘTI DISTRICT”, analyzes the method of forming real estate properties through combination based on a sale purchase agreement. It also describes in detail the entire procedure and all steps required to prepare a well-structured report in accordance with the regulations currently in force.
