The paper is dedicated to resolving issues related to the specific legal regulations on the institution of the surface, because the permanent changes in the legislative framework and the lack of a uniform practice on the judicial resolution of disputes arising from the establishment of the right of legal surface on real estate, raise many questions, and this paper helps to clarify important issues in the field under research.
